Brunswick ordinance defense with accurate transfer guidance

Brunswick’s General Offenses Code organizes person offenses in Chapter 636, property offenses in Chapter 642 and peace disturbances in Chapter 648. The complaint’s exact section determines the elements, offense level, possible penalties and whether Mayor’s Court may hear the matter.

Chapter 636 includes assault, aggravated menacing, menacing, child endangering and telecommunications harassment. Chapter 642 includes criminal damaging and trespass. Chapter 648 includes disorderly conduct. I review the required mental state and evidence for the specific ordinance rather than treating every misdemeanor as the same.

Ohio law excludes domestic violence, violating a protection order and specified family-or-household-member violence allegations from mayor’s-court jurisdiction. The City also states that a not-guilty plea to a criminal complaint transfers the case to Medina Municipal Court for trial.

Brunswick Ordinance 636.02 — assault

Brunswick’s person-offense chapter identifies 636.02 as assault. The alleged physical harm, mental state, witnesses, video, injuries and self-defense issues should be reviewed, along with whether the circumstances elevate the matter beyond a municipal misdemeanor.

Ordinance 636.14 — telecommunications harassment

The local chapter identifies telecommunications harassment as 636.14. The charged subsection, messages, calls, sender identity, recipient, context, repetition and required purpose or intent may matter.

Criminal damaging and trespass

Chapter 642 identifies criminal damaging as 642.10 and criminal trespass as 642.12. Ownership, privilege, notice, purpose or recklessness, damage, identification and recordings can be important.

Disorderly conduct

Chapter 648 identifies disorderly conduct as 648.04. The conduct, location, warnings when relevant, intoxication, speech and surrounding circumstances affect the applicable subsection and evidence.

Domestic violence is not a Brunswick Mayor’s Court case

Although Brunswick Chapter 636 contains a domestic-violence ordinance, ORC 1905.01 excludes domestic violence from mayor’s-court jurisdiction. Those cases proceed in the court with jurisdiction rather than remaining in Brunswick Mayor’s Court.

Yes, if the offense authorizes jail. Whether jail is imposed depends on the charge, facts, record, court and outcome.

A violation of ORC 2919.27 ordinarily is a first-degree misdemeanor, but specified prior convictions can elevate it to a fifth-degree felony and a violation committed while committing a felony can be a third-degree felony.

Can text messages lead to a telecommunications-harassment charge?

Yes, depending on the charged subsection, purpose and complete context. Authorship, the full message history, prior communications, alleged threats and the accuracy of screenshots should be reviewed.

Can the prosecutor dismiss a misdemeanor?

A dismissal may occur in an appropriate case, but it is not automatic. The evidence, law and circumstances must be reviewed.
