The defense may begin before indictment with an arrest, bond hearing or municipal-court proceeding and then continue through common pleas arraignment, discovery, pretrials, motions, negotiations and trial preparation. Every count and specification should be analyzed separately.

The application generally belongs in the court that entered the final judgment.
